These Terms and Conditions set out the basis on which Waste Clearance Twickenham provides waste clearance and related services. By booking or using our waste collection services, you agree to be bound by these terms. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, organisation or other entity that requests or receives services from Waste Clearance Twickenham.

Services means waste clearance, rubbish removal, bulky item collection, recycling collection, and any related or ancillary services provided by Waste Clearance Twickenham.

Waste means any items, materials, goods, rubbish, debris or similar matter requested by the Customer to be removed, collected, transported or disposed of by us, excluding any prohibited or hazardous items as defined in these terms or under applicable law.

Agreement means the contract between Waste Clearance Twickenham and the Customer comprising these Terms and Conditions and any written or verbal confirmation of a booking.

2. Scope of Services

Waste Clearance Twickenham provides waste clearance and collection services for domestic, commercial and other customers. Our services may include removal of household waste, garden waste, office waste, bulky items, light construction waste and general rubbish, subject to applicable waste regulations and our operational limitations.

We reserve the right to refuse collection of any waste that we reasonably believe to be hazardous, prohibited, illegal, improperly contained, or otherwise unsuitable for collection or transport under applicable law or industry practice.

3. Booking Process

3.1 Bookings may be made by telephone, email or via any online booking facility we operate. A booking is only considered confirmed when we have accepted the request and provided a booking confirmation, which may be given verbally, by email or in writing.

3.2 At the time of booking, you must provide accurate information about:

(a) the collection address and access details;

(b) the type and estimated volume or weight of waste to be collected;

(c) any special requirements, restrictions or potential access issues; and

(d) any time constraints or deadlines.

3.3 Our quotation and confirmation are based on the information you provide. If, upon arrival, the actual waste, access, or service requirements differ materially from what was described, we may adjust the price, revise the service specification, or decline to carry out the work. Any additional charges will be discussed with you before proceeding.

3.4 The Customer must ensure that a responsible adult is present at the collection address at the agreed time to provide access, confirm the items to be removed, and authorise any variations to the agreed service.

4. Service Times and Access

4.1 We will use reasonable efforts to attend the collection address at the agreed date and time or within any stated time window. However, all times are estimates and may be affected by traffic, weather, operational constraints or events outside our control. We are not liable for any loss or inconvenience arising from early or late arrival, provided we use reasonable care and skill.

4.2 The Customer is responsible for ensuring safe and reasonable access to the premises, including any parking arrangements, permits, keys, codes or security instructions. Where parking charges, tolls or similar costs apply, these may be added to the final invoice unless otherwise agreed.

4.3 If we are unable to gain access to the premises or to carry out the service due to circumstances within the Customer's control, we may charge a call-out or wasted journey fee to cover our reasonable costs.

5. Customer Responsibilities

5.1 The Customer must ensure that all waste intended for collection is clearly identified, safely accessible and not mixed with items that are not to be removed.

5.2 The Customer is responsible for:

(a) ensuring that any items to be collected are free from dangerous substances or concealed sharp objects;

(b) informing us of any hazardous, restricted or unusual waste materials;

(c) complying with all applicable laws and regulations relating to the waste, including any duty of care obligations.

5.3 We are not responsible for mistakenly removing items where they have not been clearly separated or identified as items that are not to be collected. The Customer should remove any personal or valuable items from the collection area before our team arrives.

6. Pricing and Quotations

6.1 Prices may be based on volume, weight, labour time, type of waste, access conditions, disposal charges and any other relevant factors. Quotations are given in good faith based on the information provided by the Customer at the time of booking.

6.2 All quotations are exclusive of any applicable taxes unless otherwise stated. If VAT or other taxes are chargeable, they will be added at the prevailing rate.

6.3 If the waste volume, weight or nature is significantly different from that described at the time of booking, we reserve the right to revise the quotation. Any changes will be agreed with the Customer before the service is carried out or continued.

7. Payments and Invoicing

7.1 Payment is due on completion of the service, unless we have agreed alternative payment terms in writing prior to the service date.

7.2 We may accept payment by cash, bank transfer, card payment or other methods as advised during the booking process. We reserve the right to require part or full payment in advance, particularly for large or commercial jobs.

7.3 For account customers or commercial clients with agreed credit terms, invoices must be paid by the due date stated on the invoice. If no date is stated, payment is due within 14 days of the invoice date.

7.4 We may charge interest on overdue sums at the statutory rate applicable to late payments, accruing daily until payment is received in full. We may also suspend further services until all outstanding amounts have been paid.

8. Cancellations and Changes

8.1 The Customer may cancel or amend a booking by contacting us directly. We request as much notice as possible in order to reallocate resources.

8.2 If a cancellation is received more than 24 hours before the scheduled collection time, no cancellation fee will normally apply. Cancellations received less than 24 hours before the scheduled time may incur a reasonable cancellation charge to cover our costs.

8.3 If we arrive at the premises at the agreed time and are unable to carry out the service due to the Customer's act or omission, or because the Customer cancels on arrival, we may charge a call-out or wasted journey fee.

8.4 We reserve the right to cancel or reschedule a booking where we are unable to provide the service due to unforeseen circumstances, safety concerns, staff illness, vehicle breakdown, extreme weather, changes in applicable regulations, or events beyond our reasonable control. Where possible, we will offer an alternative date or time.

9. Waste Regulations and Prohibited Items

9.1 Waste Clearance Twickenham operates in accordance with applicable UK waste management and environmental regulations. All waste collected will be transported and disposed of using authorised facilities and methods, with the aim of maximising reuse and recycling where reasonably practicable.

9.2 We do not normally accept the following types of waste, unless explicitly agreed in advance and subject to any special conditions: hazardous or clinical waste, asbestos, large quantities of paint or chemicals, gas cylinders, fuel, oils, explosives, pressurised containers, and any other substances classified as hazardous or controlled under relevant legislation.

9.3 If hazardous or prohibited materials are discovered among the waste at the time of collection, we may refuse to collect those items, adjust the price, or decline to proceed with the service. The Customer remains responsible for any such materials and for any consequences of failing to disclose them.

9.4 The Customer warrants that the waste presented for collection is their property or that they have the authority to arrange its removal. By presenting items for collection, the Customer transfers ownership of such waste to us at the point of loading onto our vehicle, subject to compliance with all applicable laws.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in carrying out the services. However, except as set out in this Agreement or required by law, all warranties and conditions are excluded to the fullest extent permitted.

10.2 Our total liability for any loss or damage arising out of or in connection with the services, whether in contract, tort, negligence, breach of statutory duty or otherwise, is limited to the amount paid or payable by the Customer for the specific service giving rise to the claim.

10.3 We are not liable for:

(a) any indirect, consequential or economic loss, including loss of profit, revenue, business or opportunity;

(b) any loss or damage arising from inaccurate, incomplete or misleading information provided by the Customer;

(c) any damage to items that the Customer has requested to be taken as waste, or that were not clearly separated from such waste;

(d) normal wear and tear or damage caused by reasonable handling of bulky or awkward items where due care has been taken.

10.4 The Customer must notify us of any apparent damage to property or other concerns as soon as reasonably practicable and, in any case, within 48 hours of completion of the service. We may request evidence, photographs, access to inspect the damage, and a reasonable opportunity to remedy the issue.

10.5 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter in respect of which liability cannot be lawfully limited or excluded.

11. Insurance

11.1 Waste Clearance Twickenham maintains appropriate insurance cover for its operations, including public liability insurance, in line with industry practice. Details of cover may be provided upon reasonable request.

11.2 The existence of insurance does not extend or increase our liability beyond the limitations set out in these Terms and Conditions.

12. Complaints

12.1 We aim to provide a reliable and professional waste clearance service. If you are dissatisfied with any aspect of our service, please contact us as soon as possible with full details of your concern.

12.2 We will investigate complaints in good faith and seek to resolve them promptly, which may include offering to revisit the site, rectify any issues where appropriate, or explain our findings. Our decision will be based on the evidence available and the terms of this Agreement.

13. Data Protection and Privacy

13.1 We will collect and process personal information about Customers only as necessary to manage bookings, provide services, issue invoices and handle enquiries or complaints.

13.2 We will take reasonable steps to keep personal data secure and will not share it with third parties except where required to provide the service, to comply with legal obligations, or where you have given consent, in line with applicable data protection legislation.

14. Force Majeure

14.1 We are not liable for any delay or failure to perform our obligations where such delay or failure results from events or circumstances beyond our reasonable control, including but not limited to extreme weather, accidents, road closures, strikes or industrial disputes, acts of government or regulatory bodies, pandemics, or disruption to power or transport.

14.2 In such cases, we will use reasonable efforts to resume normal operations as soon as it is safe and practicable to do so, and may offer to reschedule affected bookings.

15. Amendments to these Terms

15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice, or our operating procedures.

15.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time your booking is confirmed, unless a change is required by law or regulation.

16. Severability

16.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted, but the remaining provisions will continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By placing a booking with Waste Clearance Twickenham or using any of our waste collection or clearance services, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
